#Kodak Puts #Patent Portfolio on Market

Eastman Kodak Co. has kicked off its patent sale, as the beleaguered imaging company seeks to ride the bull market for patents and capitalize on its intellectual property in the booming market for tablet computers, The Wall Street Journal reported Wednesday.

Investment bank Lazard Ltd. began marketing the portfolio this week, reaching out to companies that might be interested, said a person familiar with the matter.

Apple’s Reexamination Counsel Avoids Deposition

#Apple is currently suing #Kodak in the Western District of New York for infringing a series of patents, among them, U.S. Patent No. 5,634,074. Kodak initially replied with the customary defenses, but has now sought permission from the court to amend its pleadings to include an inequitable conduct defense, specifically that the “074 patent is unenforceable due to inequitable conduct committed by Apple, an inventor of the 074 patent and/or it attorneys during reexamination of the ‘074 patent.” The ‘074 reexamination was requested in April 2010, and completed at the end of May 2011, when the PTO issued a reexamination certificate confirming the validity of all the ‘074 claims.

Kodak may sell patent being used in lawsuits against Apple, RIM:
Eastman Kodak Co. is said to be considering the sale of one of its most valuable patents, an invention that is the key component of lawsuits against smartphone makers Apple and Research in Motion.

Kodak has previously announced it is considering the sale of 1,100 patents, which would amount to 10 percent of its portfolio. One of those patents, The Wall Street Journal confirmed Tuesday, is the image-previewing invention upon which Kodak's lawsuits against Apple and RIM are based.
