Myhrvold throws a party and surprise: the press was invited!
Somehow I can imagine Richard Vines sitting there eating thinking "Must not mention Lodsys, must not mention Lodsys".  After all he wouldn't want to upset Microsoft's "Guru", he might not get invited back to the next party!  Despite Vines groveling Myhrvold can't help but think we're all scum, except him of course.  After all he's a famous inventor...the patent troll "protection" business.

What #Google Gets With #Motorola Mobility | Techdirt

On the very face of it, Google doesn't need a handset subsidiary to make a custom Google phone. They can easily commission a handset exactly how they want it from OEM brands like HTC and Samsung, and have already done just that with the Nexus models. They could easily design their own brand of phones and have it built by contract manufacturers like Foxconn (as Apple does). I've read elsewhere that Google now gets the benefit of better understanding of the challenges of integrating Android into handsets. That's also incorrect. Google has a history of sending teams of engineers to most of their handset and tablet partners to work side by side overcoming those challenges.

Perhaps Google just saw a good deal on Motorola. Its stock price has been dropping through the decade, and also the past year. The market value prior to today was just $7.3 Billion, compared to $20B for Nokia or $13B for RIM. Perhaps, like Nortel before it, the value of Motorola's Intellectual Property (IP) is being hidden by a poor operational record.

#HTC Sues #Apple Over #Patents, Wants Injunction And Lots Of Damages

HTC has filed a suit in the U.S. District Court in Delaware claiming that Apple has infringed on three of their patents by producing what they refer to in legalese as “Accused Apple Products.” The list of said products is extensive, to say the least: it lists among other things “personal computers, mobile communications devices, wireless printers, streaming wireless capable television, wireless network equipment [and] portable digital music and video players.” In short, nearly everything that Apple makes allegedly infringes on the patents that HTC owns.

Samsung Mobile Buys Steve “Cyanogen” Kondik For An Undisclosed Amount

In other acquisition news, it appears #Android developer extraordinaire, Steve Kondik AKA Cyanogen, was picked up by Samsung Mobile for an undisclosed amount according the recent change in his “work” status today on Facebook. Seems Steve found himself a software engineering job for the Korean based company thanks to his exceptional work on CyanogenMod, a custom ROM supporting a broad range of devices built entirely from Android open source. CyanogenMod brings users a slightly enhanced “Google experience” to their phones, untouched by a lot of the UI fluff and changes found in many OEM devices like HTC’s Sense UI and Samsung’s TouchWiz.

Last week in #patents: #Apple, #Android and trolls oh my!

In the fluid smartphone market, this week it was reported that Apple became the top vendor for the first time claiming 19.1% in the second quarter of 2011 with Samsung claiming 16.2%. It was also reported that the iPhone had, indirectly, come to dominate not only the private consumer market but enterprise IT.

Android continues its astronomical growth, last week it was reported that Android accounted for 53% of all ad impressions and claiming 43% of the market share in the second quarter of 2011. Oracle asked the courts to force Google to reveal its Android revenue. Scott Daniels discussed Google's attempts to invalidate Oracle's patents being used in their Android battle. Google accused Microsoft of releasing its proprietary code.

Apple was sued by a possible LG shell company in Florida over the fast booting used in OSX. Florian Mueller suspects it's a preemptive strike in the patent proxy war surrounding Android, which has thus far spared LG but only because of their smaller market share.

Apple was granted additional important patents regarding its touch-screens, no doubt there will be little wait in their use in litigation against its competitors.

Following its success in Australia, Apple succeeded in blocking the release of Samsung's Galaxy Tab 10.1 in the European Union except the Netherlands where a different lawsuit is underway. Samsung is of course, appealing with a date set for August 25th. It was also reported that Apple is also targeting Motorola's Xoom tablet, escalating the the already chaotic Android legal battle.

With Apple and Microsofts success in impeding competitors products through litigation and licensing fees, it's not surprising that Motorola may be joining them in extracting such fees from other Android makers.

HTC is opening to negotiating a deal with Apple, it all comes down to just how much Apple is going to charge in order to settle their numerous lawsuits and what if any, cross-licensing arrangements can be made. HTC continues its acquisitions, buying Beats Electronics, a high-end speaker and headphone maker cofounded by Dr. Dre and will begin using Beats' audio technology in its handsets.

Huawei Technologies accused rival Inter Digital of filing infringement claims against it to boost the value of its patents while courting bids from Google, Apple, and Samsung for them.

Android was also updated to allow its phones to rent movies.

Rovio and EA are urging the federal court to allow Apple to directly intervene in the patent-infringement case targeting iOS developers by Lodsys. Meanwhile Google's response, whose Android developers have also become a Lodsys target, is to seek the invalidation of Lodsys's patents, much to the consternation of Florian Mueller: Google risks alienating its Android developer community if it doesn't do more and quickly, to clear up all the litigation surrounding Android.

Cisco and Twitter joined a Linux patent protection pool, hopefully it's not as devious as Intellectual Ventures which announced a licences deal with LCD maker Chunghwa. Intellectual Ventures is also suing 100+ media companies.

Sony and LG settled their 3 year patent dispute over TV and Blu-ray technology with a cross-licensing arrangement.

Speculation about the iPhone5 and an iOS 5 powered iPad3 release date were abound, meanwhile rumors were spread that Windows Phone "Mango" will be released September 1st and Android's "Ice Cream Sandwich" will likely come at the end of 2011.

With the debt deal past them, Congress looks ready to pass some form of patent reform, whether it will do any good remains to be seen, but Mike Elgan is skeptical. News surfaced of possible legislation to curb the lawsuits generated by non-practicing entities or patent trolls.

Tim Richardson defended NPEs, explaining that software patents were just as sellable as anything else. Timothy Lee continued making the case for invalidating software patents and conducted a very enlightening discussion with Julian Sanchez on topics ranging from NPEs, software patents, and the charges against Aaron Swartz, if you've got 35 minutes I strongly suggest listening to it. Brad Feld, Martin Fowler, and Brian Kahin also make the case against software patents. Meanwhile, Nilay Patel defends the software patent system.

ANALYSIS-Apple going after Google in tablet spats? | Reuters

The maker of the iPad and iPhone has sued three of the largest manufacturers of Google's Android-based devices -- Samsung, Motorola and HTC -- for multiple patent infringements across multiple countries, pointing out "slavish copying" of design and "look and feel."
While the lawsuits don't take direct aim at the operating software -- yet -- many of the features under contention are connected to and enhanced by it. Apple CEO Steve Jobs once referred to the software as being the soul of any device when he introduced the company's iOS 5 system in June.

Brian Marshall, an analyst with Gleacher & Co, said Apple is starting to flex its patent muscle with some early success but its real battle is with the Android software. 'Apple doesn't really care too much about the actual OEMs.'

Will #Apple Play Hardball with #HTC in #Android #Patent Battle?

For now, the trouble in assessing litigation risks stems from an inability to determine how punitive Apple will actually be if it wins a final ruling, expected to be made by the U.S. International Trade Commission in December, that HTC infringed on two of its patents having to do with the recognition and storage of email addresses and phone numbers.

HTC lost a preliminary ruling on those patents on July 15.

Quite a few analysts believe Apple and HTC might come to a cross-licensing agreement that will cost HTC a fixed sum per handset. HTC has most likely already made provisions for such a settlement, these analysts say, and it would be unlikely to do excessive long-term damage to the company.

#Motorola signals intent to begin #patent action against other #Android licensees

While Google has accused #Apple, #Microsoft and #Oracle of a conspiracy to bring down its Android platform using patent infringement claims, Google's own licensees are suing each other, with Motorola intimating its intent to join this trend.

Motorola is one of few companies to move exclusively to Google's Android platform; Samsung, LG, HTC and other leading mobile makers have retained relationships with Microsoft's Windows Phone 7, or maintain their own mobile platform, like Samsung's Bada.

Google has asked a judge at the International Trade Commission to sanction Microsoft, saying that the company revealed “highly confidential source code” to an expert witness in violation of the court’s rules. The expert accessed the source code as part of Microsoft’s ITC case against Motorola, which alleges that some Android-powered Motorola phones violate Microsoft patents.

Microsoft’s ITC case against Motorola is one of several “proxy battles” against Android-powered phones. Microsoft wants to use patents to collect royalties on every Android-powered handset, and has reached settlements in some cases, including with HTC. But Motorola is fighting back hard, and launched its own ITC counter-suit not long after Microsoft kicked off the fight. Both ITC cases are still pending

#HTC to buy stake of Beats Electronics for $309 million | Reuters

Smartphone maker HTC will buy a 51 percent stake of U.S. company Beats Electronics for $309 million, it said on Thursday, its latest move to fend off rising competition and enhance its branding.

#Apple Becomes Top #Smartphone Vendor For The First Time

In the rapidly growing smartphone market, where (almost) everyone’s a winner, Apple is currently the winningest of them all. According to research firm IDC, in the second quarter of 2011, Apple’s iPhone outsold all other brands for the first time.

Year-over-year, the smartphone market has shifted wildly and dramatically. Apple’s market share jumped from 13% to 19.1% to give it the top spot, but number-two Samsung actually grew by a far greater percentage, from 5.6% to 16.2%.

"Slowly but surely, HTC is building up its software expertise. The smartphone maker announced this morning that it has acquired Seattle-based Dashwire, creator of a mobile backup and synchronization service for smartphones, for $18.5 million.

Dashwire’s technology will make its way to the company’s HTCSense.com cloud service. But the purchase will also equip HTC with patents that could help it to avoid future squabbles like its current patent battle with Apple."

HTC has filed another lawsuit against Apple in the U.K., further escalating the patent battle between the two smartphone manufacturers.

Bloomberg reported today that the suit was filed on Friday in London. The suit comes two weeks after HTC suffered a blow when the U.S. International Trade Commission made an initial ruling that the Taiwanese company had violated two of Apple's patents.

S3 Patents that Apple Violated Were Ruled Unpatentable | Analysis | The Mac Observer:
In a rather interesting turn of events, the two patents owned by S3 that the U.S. International Trade Commission (ITC) were being violated by Apple’s Mac OS X operating system have been ruled to be unpatentable due to prior art by the U.S. Patent & Trade Mark Office (USPTO). The curious thing about the ruling, however, is that it came the same day as the ITC ruling, five days before HTC bought S3 in order to use that ITC ruling against Apple...


According to Mr. Macari’s analysis, there isn’t anything that necessarily binds the ITC to pay attention to USPTO reviews, but it’s common for it to do so. The other two S3 patents were still being reviewed, however, and it’s a complete coincidence that the USPTO’s review findings were issued on the same day that AL Gildea issued his own ruling.
All this happened on July 1st — the ITC found that Apple was infringing on the S3 patents (it was July 26th when the ITC revealed some details of the ruling, including that it was Apple’s Mac OS X that infringed, clearing iOS in the process) and the USPTO ruled those same patents as unpatentable.

HTC Willing To Talk It Out With Apple Over Mobile Patents | mocoNews

After a bruising round at the International Trade Commission that saw two of HTC’s products declared in violation of Apple patents, it seems HTC has decided that it wants to talk things out, according to comments made by its chief financial officer and reported by Bloomberg. The company’s stock price has suffered in the wake of that decision as well as following HTC’s decision to buy S3 Graphics—a company that has scored patent wins against Apple—for $300 million, and it rose following word that talks were on the table.

There’s no sign that Apple is actually willing to talk (in trademark fashion, an Apple representative didn’t respond to Bloomberg’s inquiries), but very rarely do technology patent cases actually come down to an injunction prohibiting the sale of the losing products that is threatened at every turn. They’re almost always settled with money, be it lump sums, ongoing royalty payments, or both. Apple recently settled its patent dispute with Nokia by agreeing to ongoing royalty payments.

But despite the appearance that Android won, the ecosystem is now facing the looming potential of doom. That doom could come thanks to Apple, RIM, and Microsoft's growing portfolio of purchased intellectual property and desire to sue Android handset makers into submission.

Apple currently is suing HTC, Samsung, and Motorola in cases that stretch across multiple countries and continents. Microsoft is suing Motorola as well and is using legal threats to try to force Samsung into a per phone licensing deal (as much as $15 USD per Android phone sold), as it did with HTC last year. Likewise, Oracle Corp. is seeking $6.1B USD in damages, claiming that Android is infringing on the Java patents it obtained in its acquisition of Sun Microsystems.

The combined picture is clear. Apple and Microsoft have sued or entered into sweet licensing agreements with virtually every major Android maker (a few like LG Electronics Inc. have been spared, presumably on the merits of their smaller market share)."

HTC Pays Microsoft $5 Per Android Phone, Says Citi:
Microsoft gets $5 for every HTC phone running Android, according to Citi analyst Walter Pritchard, who released a big report on Microsoft this morning.
Microsoft is getting that money thanks to a patent settlement with HTC over intellectual property infringement.

Microsoft is suing other Android phone makers, and it's looking for $7.50 to $12.50 per device, says Pritchard.
